Terms of Service

Last Updated: September 2026

1. Educational Assistance & Probabilistic Nature

Tabitha.ai provides AI-assisted pedagogical analysis, handwriting OCR, rubric scoring, and comment generation designed to empower educators. Detection scores and grading recommendations are probabilistic pedagogical aids meant to support professional teacher discretion, not serve as the sole determinant for disciplinary action or official student records.

2. Account Registration & Acceptable Use

Educators agree to provide accurate registration information and maintain credential confidentiality. The service may not be used to violate academic integrity, reverse-engineer proprietary OCR models, or upload content that infringes upon third-party rights or applicable laws.

3. Subscriptions & 1-Click Cancellation

Tabitha Pro subscriptions renew automatically on a monthly basis. Teachers can cancel their subscription at any time with a single click from their billing management dashboard without penalty, maintaining active access through the end of the paid billing cycle.

4. Intellectual Property & User Content

Educators retain full intellectual property rights to all rubrics, comments, feedback slips, and teacher notes created within Tabitha.ai. Tabitha does not claim ownership over any user-generated or uploaded student content.

5. School District Licensing & Purchase Orders

Institutional agreements, district site licenses, and purchase order billing terms are governed by supplementary enterprise service agreements executing between Tabitha.ai and the contracting educational entity.

6. Service Availability & Scheduled Maintenance

While we strive for continuous 99.9% uptime during active academic terms, maintenance windows are scheduled during off-peak weekend hours with advance educator dashboard notification. Our vision processing clusters are architected with automatic failover to preserve uninterrupted classroom access.

7. Fair Use & High-Volume Ingestion Policies

Educator accounts are intended for typical individual classroom grading volumes. School departments conducting school-wide or district-level testing benchmarks should utilize institutional department licenses to guarantee dedicated GPU clustering and priority batch queuing.

8. Dispute Resolution & Governing Law

These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the educational contracting entity resides. School districts retain their full sovereign and governmental immunities under applicable state education codes.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Tabitha.ai and its creators shall not be liable for indirect, incidental, or consequential damages resulting from the use or inability to use our pedagogical tools.

10. Contact & Legal Notices

For inquiries regarding our terms, institutional agreements, or school district contracts, please email [email protected].

11. Service Level Agreements (SLA) for School Districts

Institutional subscriptions under district service agreements include 99.9% uptime commitments during standard school calendar instructional hours, priority GPU cluster allocation for high-volume scanning periods, and dedicated technical account management with rapid 2-hour response guarantees during exam cycles.

12. Acceptable Use & Academic Integrity Safeguards

Tabitha is designed exclusively as an instructional co-pilot to empower educators. Any use of the platform to intentionally falsify student records, fabricate evaluative scores without teacher review, or circumvent institutional privacy policies is strictly prohibited and constitutes grounds for immediate account termination without refund.

13. Entire Agreement & Severability

These terms constitute the entire agreement between the educator and Tabitha.ai regarding individual accounts. Should any provision of these terms be deemed invalid or unenforceable under applicable state or federal law, the remaining provisions shall remain in full force and effect.

14. Department Shared Rubric Licensing

When educators contribute custom rubrics to institutional shared department repositories, the contributing teacher grants colleague faculty within that school building non-exclusive rights to apply and adapt the rubric for classroom instructional assessment.

15. Export Control & Sanctions Compliance

The service is controlled and operated from data centers situated in North America and Western Europe. Educators agree to comply with all applicable national and international export and re-export control laws and regulations regarding access to neural computer vision and machine learning technologies.

16. Modifications to Terms & Advance Educator Notice

We reserve the right to update these terms to reflect evolving legal mandates, pedagogical features, or operational standards. In the event of material modifications that alter teacher rights or data protections, Tabitha provides at least 30 days of advance notice via email and prominent dashboard banner announcements.

17. Severability & Non-Waiver of Rights

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions remain fully effective.

18. Teacher Primacy & Discretionary Authority

Educators explicitly retain ultimate discretionary authority regarding all evaluations, marks, comments, and disciplinary considerations. Tabitha operates exclusively as an administrative co-pilot and formative grading assistant; no automated decision with legal, disciplinary, or official transcript consequences is executed without independent educator oversight and final approval.

Educators agree to review generated feedback slips, report card comment drafts, and AI detection scores for contextual appropriateness and fairness prior to distribution to students, guardians, or administrative records.
